Terms of Agreement

TERMS OF AGREEMENT
Between Client and Salmon River Services LLC dlb/a All Rivers Shuttle
PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS AND EXCLUSIONS THAT MIGHT APPLY TO YOU.
By booking a shuttle services Reservation with Salmon River Services LLC d/b/a All Rivers Shuttle (“ARS”), I (“Client”) hereby agree to be bound by the following terms and conditions (the “Agreement”). If you do not agree to these terms and conditions, you should not obtain products or services from this website. These terms and conditions are subject to change by ARS (referred to as “us” or “we”) without prior written notice at any time, in its sole discretion. The latest version of the terms and conditions will be posted on this website, and you should review these terms and conditions prior to purchasing and/or completing any Reservation Form available through this website.
WHEREAS, Client is the legal owner of the vehicle(s) identified in the Reservations Form (“Subject Vehicle(s)”) or, if Client is not the owner, Client has authority to enter into this Agreement with regard to the Vehicle(s) identified in the Reservations Form.
WHEREAS, ARS is engaged in the business of facilitating shuttling services for vehicles and boats through third-party Drivers, and Client is the legal owner, or a person with authority to act on behalf of the legal owner, of the Subject Vehicle(s) which require shuttling.

WHEREAS, ARS will enter into an agreement with a Driver, whereby the Driver, as an independent contractor, will transport the Subject Vehicle(s). Any such Driver is not an employee, officer, or agent of ARS. ARS makes no representations or warranties with regard to any Drivers skill or ability and assumes no responsibility or liability for the conduct of any Driver, whether negligent or intentional,
Now, therefore, in consideration of the premises and of the agreements set forth below as well as those included in the Reservations Form found here: https://allriversshutt1e.com/https­gsbmwcchrt-fonnstack-com-forms-a11-rivers-form-2011-copy/, and incorporated as if fully set forth herein, the Client and ARS respectively agree as follows:

1. Order Acceptance. Client’s receipt of an electronic or other form of order confirmation does not signify ARS’ acceptance of your order, nor does it constitute confirmation of ARS’ offer to sell. ARS reserves the right at any time after receipt of your Reservation to accept, decline, or limit your Reservation for any reason, whether or not your credit card has been charged. If your credit card has been charged and your Reservation is canceled by ARS, you will receive a prompt refund. Client’s Reservation is accepted by ARS upon receipt by Client of the second of two email confirmations from ARS.
2. Payment. Client’s credit card will not be charged at the time Client submits the Reservation Form. Terms of payment are within ARS’ sole discretion and, unless otherwise agreed by ARS in writing, payment must be received from Client prior to acceptance of a Reservation.
3. Disclaimer and Limitation of Liability. ARS’ responsibility for payments to Client relating to the products and services available through this website is limited to the procedures described in our Cancellation Policy set forth in the Reservations Form and incorporated herein.

ARS DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN. IN NO EVENT SHALL ARS OR ITS AFFILIATED COMPANIES, AGENTS, EMPLOYEES, OR OFFICERS (COLLECTIVELY, OUR “AFFILIATES”) HA VE ANY OBLIGATIONS OR LIABILITIES TO CLIENT OR ANY OTHER PERSON WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY OR FORM OF ACTION, ARISING OUT OF OR IN CONNECTION WITH THE SALE, DELIVERY, OR PERFORMANCE OF THE SHUTTLING SERVICES AVAILABLE THROUGH THIS WEBSITE. NO EMPLOYEE OR REPRESENTATIVE OF ARS IS AUTHORIZED TO MODIFY THIS LIMITATION.
ARS’ SOLE AND ENTIRE MAXIMUM LIABILITY FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY CLIENT FOR THE PRODUCTS AND SERVICES YOU HA VE ORDERED AND/OR RESERVED THROUGH THIS WEBSITE.

4. Insurance. Client agrees that the Subject Vehicle(s) are registered and covered by including bodily injury or property damages, arising out of or in any way relating to Client’s use of ARS services, including but not limited to the intentional or negligent acts of any independent Driver procured by ARS in furtherance of the shuttling services.
5. Force Majcurc. In addition to any excuse provided by applicable law, ARS shall be excused from liability for non-delivery or delay in delivery of products and services available through this website arising from any event beyond ARS’ reasonable control, whether or not foreseeable, including but not limited to, labor disturbance, war, fire, accident, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.
6. Entire Agreement. These terms and conditions, which incorporate those terms identified in the Reservation Form, constitute the entire agreement and understanding between Client and ARS concerning the subject matter hereof and supersede all prior agreements and understandings of the parties with respect thereto. These terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement or amend this document or to enter an order or Reservation for products or services which are subject to additional or altered terms and conditions shall be null and void, unless otherwise agreed to in a written agreement signed by ARS and Client. To the extent that anything in or associated with website is in conflict or inconsistent with these terms and conditions, these terms and conditions shall take precedence.
7. Electronic Signature(s). Client and ARS authorize the use of electronic signature(s) for purposes of signing and assenting to the terms of this Agreement. 

8. Severability. In the event that any provision of this Agreement is found to be unenforceable for any reason, such provision shall be null, void, and severed from the Agreement, and the remaining provisions shall be of full force and effect.
9. Governing Law and Forum. This website is controlled by ARS from our offices within the State of Idaho, United States of America. It can be accessed from all 50 states, as well as from other countries around the world. As each of these places has laws that may differ from those of Idaho, by accessing this site and/or utilizing ARS’ products and services, Client agrees that the statutes and laws of the State of Idaho, without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of this website and the purchase of products and services available through this website. Each of us agrees and hereby submits to the exclusive personal jurisdiction and venue of Idaho County, Idaho.

I (the client of All Rivers Shuttle ) accept the terms of Agreement and Acknowledgement of Risk & Waiver of Liability as stated below by accepting the option on online form.

I have a full tank of gas or near full and/or have
left instruction and money or asked to be invoiced for a full tank
of gas.  I have checked my fluids, (oil, transmission, water)
and my vehicle is in good driving conditions for the roads that will
be traveled to the take out.  I have started my vehicle and
driven it for more than a minute with my spare key if it is a spare
key that was made at a place other than the dealership.  I will
disable the alarm or give good directions on how to disable the
alarm.  I will remove all open containers of alcohol or other
illegal items so that the driver of my vehicle will not be charged
in case the vehicle is inspected by a law officer.  In case my
vehicle becomes inoperable, unsafe, or unlawful for any reason
(including but not limited to:  engine or mechanical failure,
security issues, ignition or gas cap key problem, no spare tires,
unsafe trailer, illegal transport of vehicles with another vehicle
on it, or any situation in which the driver is not safe to operate
the vehicle, I authorize All Rivers Shuttle to exercise the option
on my behalf that is stated by me on the form and will execute my
directions that I have provided.

I understand that the the roads driven may be rough and poorly maintained and I will not hold All Rivers Shuttle responsible for the damage done to the vehicle while en route or parked.  Permission is hereby granted to drive the vehicle above and it is covered by public liability and property damage insurance that will cover the vehicle and shuttle driver.  The vehicle has at least 100.00 deductible collision and comprehensive insurance.  If it does not, I understand that I am liable for charge resulting form any deficiency in coverage.

The company All Rivers Shuttle, solicits cars for the drivers that are contracted to the service. In the case of an act of God or a natural disaster and we are unable to use a specific route, All Rivers Shuttle may contract out other available shuttle services who can make the delivery by your take out date.

We will not shuttle vehicles do not have a real tire for a spare (not  a doughnut tire) on the Main Salmon, Middle Fork and Selway Rivers.  If you leave me with bald tires on your vehicle, I will purchase new or used tires to complete the trip and charge your card, as you may take that risk, but I will not allow my drivers to shuttle hundreds of miles on unsafe bald tires.

Shuttle Cancellation Policy

We know life can be unpredictable and things happen.  We highly recommend trip insurance which will cover shuttles and incidentals if you need to cancel your trip. It is relatively affordable and easy to set up,  below are some links to companies that you can get trip insurance for!

5% on the LSR and SNAKE River, 10% on Main, MF, Selway, South Fork unless shuttle is canceled 7 days ahead of time.  Acts of God, Fires, Low Water, emergencies are all part of life, but you still will be assessed the fee of canceling.   If you replace a shuttle with another vehicle you will not be assessed the fee and exceptions may apply, but understand that there are fees and time involved in processing your forms. Schedules are made, and other shuttles are turned down. It is a standard industry policy and we hope you understand.

Trailers and Keys

Trailers with cars on them are
considered a HAZMAT issue, as the gas in your tank is considered hazardous.

Because of this, I can no longer shuttle trailers with cars on them unless they are drained of fuel and an additional fee will be appropriated as I will get a CDL driver for this.

KEYS

If you do not specify where to leave the key, we will assume you have a spare set or a hidden key somewhere on the vehicle. Please specify on the form where you want us to hide the key or we will default to that.

If you tell us to find your keys somewhere and we do not find them where you indicated on the form.. there is a chance that we cannot deliver your vehicle. We will make some kind of arrangements so you will have a solution, but this too will incur a fee. Please take these details seriously. We certainly do.

Rental Van Policy:

If you rent a van provided by All Rivers Shuttle – you must return it in the condition it was rented or be subject to an additional charge, cleaning fees, mechanical fees and the will be assessed by the management.   The driver you provide that is insured under All Rivers must be the driver of the vehicle at all times and must have a legal drivers licensce.
